Welcome to fotspot® (“fotspot”, “Fotspot”, “we”, “us” or “Our”).

This Privacy Policy explains how and when we collect, use, share and protect information relating to fotspot (the “Service”) and your options about the collection and use of your information.
It applies to visitors, users and others who access the Service (“Users”)

The Service provides a way for users to create content and place it in a location for other users to see.

By using our Service you understand and agree that we are providing a platform for you to post content, including words, photos and links to websites, ("User Content"), to the Service. User Content is public by default. This means that other Users can see, use, or share any of your User Content that you make available through the Service, consistent with the terms and conditions of this Privacy Policy and our Terms of Use.

Irrespective of which country you live in, you authorise us to use your information in, and as a result to transfer it to and store it in, the United Kingdom and any other country where we operate including the United States. 3. Information we collect

We collect information about our users for three main reasons:

We collect the following types of information:

Basic Account information:

When you log-in to the Service using an Apple or Google log-in, you are granting permission to them to share your user details with us. This will include your name, email address and date of birth. You can also share your Apple or Google username and information you decide to share according to your Apple or Google account settings. If you remove the fotspot app from your Apple or Google settings, we will no longer have access to this information.

Communications between you and fotspot. For example changes to the Service and technical and security notices. Note that you may not opt out of Service related e-mails.

If you email us, we will keep your message, email address and contact information to respond to your request.

Analytics information:

We use third-party analytics tools to help us measure usage and performance. These tools collect information sent by your device.
Location information:
The Service will use information about your location. When you use the Service you are granting us permission to determine your location using data from your device, such as precise location information from GPS, information about wireless networks or nearby mobile phone network masts. You agree we can use and store information about your location to provide the Service.
Log file information:

Log file information is automatically reported each time you access the app. It may also be provided when the app is downloaded to your device.
When you use our Service we automatically record log file information about you such as your IP address, operating system and device information such as how you use the Service, including User Content viewed.

Device identifiers:

The Service will use information about your mobile device. When you use a mobile device to access the Service, we may access, collect, monitor, store on your device, and/or remotely store one or more "device identifiers” to uniquely identify your mobile device. The device identifier may be data stored in connection with the device hardware, data stored in connection with the device's operating system or other software, or data sent to the device by fotspot.

When you use the Service, we may use cookies or similar technology to collect anonymous user information about how you use fotspot.
Metadata

The Service is designed to help you share User Content. By creating a fotspot you are asking us to make it public. The fotspot will contain your User Content and metadata, such as when the fotspot was created.

4. How we use your information

In addition to some of the specific uses of information we describe in this Privacy Policy, we may use information that we receive to:

5. Sharing your Information

On fotspot your username is shown publicly in the fotspots you create.

We will not rent or sell your information to third parties without your consent, except as noted in this Policy.
We may share your information as well as information from tools like cookies, log files, and device identifiers and location data, with third-party organizations that help us provide the Service to you ("Service Providers"). Our Service Providers will be given access to your information as is reasonably necessary to provide the Service under reasonable confidentiality terms.

We may also share certain information such as cookie data with third-party advertising partners. This information would allow third-party ad networks to, among other things, deliver targeted advertisements.

We may remove parts of data that can identify you and share anonymised data with other parties. We may also combine your information with other information in a way that it is no longer associated with you and share that aggregated information.

6. Change of Control

If we sell or otherwise transfer part or all of fotspot to another organization (e.g. we are bought, merge with another company, become bankrupt, dissolved, liquidated), your information, User Content and any other information collected through the Service may be among the items sold or transferred.

7. Responding to legal requests and preventing harm
​
If the law requires us to do so we may access, preserve and share your information in response to a legal request.

We may also access, preserve and share information when we believe it is necessary to prevent harm to you, others or us.

8. Deleting your information
​
How long we keep your User Content:

We will display User Content until it expires, or the account is terminated or deactivated.
​
Following termination or deactivation of your account, fotspot or its Service Providers may retain your account information and your User Content for a commercially reasonable time.

Remember third parties may still retain copies of your public information, like your user profile information and fotspots, even after you or we have deleted the information from fotspot or deactivated your account.

9.Children's privacy
​
We do not knowingly collect or solicit any information from anyone under the age of 16 or knowingly allow such persons to register for the Service. The Service and its content are not directed at children under the age of 16. In the event that we learn that we have collected personal information from a child under age 16 without parental consent, we will delete that information as quickly as possible. Please contact us if you believe that we might have any information from or about a child under 16.

10. Other websites and services

We are not responsible for the practices employed by any websites or services linked to or from our Service, including the information or content contained within them. When you use a link to go from our Service to another website or service, our Privacy Policy does not apply to those third-party websites or services.

We may modify or update this Privacy Policy, so please review it periodically. Your continued use of the Service after any modification to this Privacy Policy will constitute your acceptance of such modification.
